Terms of Service

1. Acceptance of Terms

By accessing and using the Tip Frontier website (tip-frontier.com) and enrolling in our yachting training programs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and Tip Frontier ABN [123 456 789], a company registered in New South Wales, Australia.

2. Services Description

Tip Frontier provides professional yachting training and certification services including:

  • Basic sailing courses for beginners
  • Advanced coastal skipper licensing programs
  • Marine safety training and certification
  • Yachtmaster preparation courses
  • Sailing instructor certification programs
  • Custom corporate training solutions
  • Equipment rental and maritime consultation services

3. Enrollment and Registration

3.1 Eligibility

To enroll in our training programs, you must:

  • Be at least 16 years of age (parent/guardian consent required for minors)
  • Meet health and fitness requirements for maritime activities
  • Provide accurate and complete registration information
  • Hold any prerequisite certifications as specified for advanced courses
  • Comply with all safety requirements and instructions

3.2 Registration Process

Course enrollment requires:

  • Completion of our registration form with accurate information
  • Payment of applicable course fees
  • Submission of required medical and emergency contact information
  • Acknowledgment of risks and safety requirements
  • Agreement to these Terms of Service

4. Payment Terms

4.1 Course Fees

All course fees must be paid in full before the commencement of training unless alternative payment arrangements have been specifically agreed to in writing. Prices are listed in Australian Dollars (AUD) and include GST where applicable.

4.2 Payment Methods

We accept payment via:

  • Credit and debit cards (Visa, MasterCard, American Express)
  • Bank transfer (details provided upon enrollment)
  • Corporate billing arrangements (subject to credit approval)

4.3 Refunds and Cancellations

Refund policies vary by course type and timing:

  • More than 14 days before course start: Full refund minus 10% administration fee
  • 7-14 days before course start: 50% refund
  • Less than 7 days or no-show: No refund
  • Course cancellation by Tip Frontier: Full refund or course transfer
  • Medical emergencies: Considered on a case-by-case basis with documentation

5. Course Policies

5.1 Attendance Requirements

Students must attend all scheduled sessions to receive certification. Missed sessions may be made up at additional cost, subject to availability.

5.2 Weather and Safety

Training may be modified or postponed due to weather conditions, safety concerns, or equipment issues. Alternative dates will be offered without additional charge.

5.3 Certification

Certification is contingent upon:

  • Successful completion of all course requirements
  • Demonstration of required skills and knowledge
  • Compliance with safety standards and regulations
  • Payment of all applicable fees

6. Safety and Risk Acknowledgment

6.1 Inherent Risks

Maritime training involves inherent risks including but not limited to:

  • Drowning or near-drowning incidents
  • Injuries from boat equipment or sailing activities
  • Weather-related hazards and sea conditions
  • Falls overboard or on deck
  • Equipment failure or mechanical issues

6.2 Safety Obligations

Students must:

  • Follow all safety instructions and procedures
  • Wear provided safety equipment at all times when required
  • Report any medical conditions that may affect participation
  • Refrain from alcohol or substance use during training
  • Immediately report unsafe conditions or incidents

7. Liability and Insurance

7.1 Limitation of Liability

To the maximum extent permitted by law, Tip Frontier's liability is limited to the course fees paid. We are not liable for indirect, consequential, or special damages including but not limited to:

  • Personal injury or death (except where caused by our negligence)
  • Loss of personal property
  • Travel expenses or accommodation costs
  • Lost income or business opportunities

7.2 Insurance Requirements

Students are strongly advised to maintain appropriate personal insurance including travel insurance, health insurance, and personal liability coverage.

8. Intellectual Property

All course materials, including but not limited to training manuals, videos, assessments, and instructional content, remain the intellectual property of Tip Frontier. Students may not:

  • Reproduce or distribute course materials without written permission
  • Record video or audio of training sessions without consent
  • Use our trademarks, logos, or branding without authorization
  • Reverse engineer or copy our training methodologies

9. Conduct and Disciplinary Action

9.1 Expected Conduct

Students must maintain professional and respectful behavior including:

  • Treating instructors and fellow students with respect
  • Following all facility rules and regulations
  • Arriving punctually and prepared for sessions
  • Maintaining appropriate personal hygiene and dress

9.2 Disciplinary Actions

Violations may result in:

  • Verbal or written warnings
  • Temporary suspension from training
  • Permanent dismissal without refund
  • Legal action for serious misconduct

10. Privacy and Data Protection

Your personal information is collected, used, and protected in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

11. Website Terms

11.1 Acceptable Use

When using our website, you agree not to:

  • Use the site for any unlawful purposes
  • Attempt to gain unauthorized access to any systems

  • Equipment failures or facility unavailability
  • Labor disputes or transportation disruptions

14. Dispute Resolution

14.1 Informal Resolution

We encourage resolution of disputes through direct communication. Please contact our management team to discuss any concerns before pursuing formal legal action.

14.2 Formal Disputes

Any disputes that cannot be resolved informally will be subject to:

  • Mediation through a mutually agreed mediator
  • If mediation fails, binding arbitration under NSW commercial arbitration rules
  • Jurisdiction of New South Wales courts for any legal proceedings

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any legal proceedings must be commenced in the courts of New South Wales, and you consent to the exclusive jurisdiction of these courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them enforceable.

17. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

18. Entire Agreement

These Terms, together with our Privacy Policy and any course-specific agreements, constitute the entire agreement between you and Tip Frontier regarding the use of our services.
